By accessing or using MemeRace ("the App"), available at memeracesol.com and on the Solana Mobile dApp Store, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding End User License Agreement (EULA) between you and MemeRace.
MemeRace is an entertainment application built on the Solana blockchain in which users predict the finishing order of meme coin-themed characters in simulated races. Users deposit SOL (Solana's native cryptocurrency) into a non-custodial session balance to participate. Prizes are distributed from the shared pool according to the payout structure described in the App. MemeRace is intended solely for entertainment purposes.
You must be at least 18 years of age, or the legal age of majority in your jurisdiction, to use MemeRace. By using the App, you represent and warrant that you meet this requirement. You are solely responsible for ensuring that your use of the App complies with all laws and regulations applicable in your jurisdiction. MemeRace is not available to users in jurisdictions where such activities are prohibited by law. It is your responsibility to determine whether using MemeRace is legal in your location.
MemeRace operates on the Solana blockchain. To use the App, you must connect a compatible Solana wallet (such as Phantom). You are solely responsible for the security of your wallet and private keys. MemeRace does not have access to your private keys and cannot recover lost funds. All blockchain transactions are irreversible. By depositing SOL into the App, you acknowledge the inherent risks of blockchain technology including, but not limited to, network congestion, smart contract vulnerabilities, and price volatility.
MemeRace may award Credits ("MemeRace Credits") through daily quests, promotions, or other in-app activities. MemeRace Credits have no monetary value, cannot be withdrawn, transferred, or exchanged for SOL or any other currency or asset. Credits may only be used within the App to participate in races. Winnings generated from races entered using Credits are credited to your real SOL session balance and may be withdrawn. MemeRace reserves the right to modify, suspend, or discontinue the Credits program at any time without notice.
SOL deposited into MemeRace is held in a session balance within the App's escrow system. You may withdraw your available session balance at any time through the withdrawal function in the App. Withdrawals are processed on-chain and subject to standard Solana network fees. MemeRace is not a bank or financial institution and does not pay interest on session balances. MemeRace is not liable for any losses resulting from network failures, delays, or third-party wallet issues.
Prize pools are formed from the combined entry fees of all participants in a given race. MemeRace retains 10% of each race pool as a service fee. The remaining pool is distributed as follows: 60% to first place, 20% to second place, and 10% to third place, based on picks placed on the finishing racers. Prize positions not covered by any participant's picks are retained by MemeRace. MemeRace reserves the right to modify the payout structure at any time, with changes communicated through the App.
MemeRace is an entertainment application involving financial risk. Only participate with funds you can afford to lose. If you feel you may have a gambling problem, please seek help from a qualified professional or contact a gambling support service in your jurisdiction. MemeRace is not responsible for any financial losses incurred through use of the App.
You agree not to: (a) use the App for any unlawful purpose; (b) attempt to manipulate, hack, or exploit the App or its underlying systems; (c) use automated bots or scripts to interact with the App; (d) create multiple accounts to abuse promotions or Credits; (e) impersonate any person or entity; (f) interfere with the proper functioning of the App or the Solana network. MemeRace reserves the right to suspend or terminate access for any user found to be in violation of these prohibitions.
All content within MemeRace, including but not limited to graphics, logos, game mechanics, code, and trade dress, is the intellectual property of MemeRace and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or lease any part of the App without prior written consent.
MemeRace is provided "as is" and "as available" without warranties of any kind, express or implied. MemeRace does not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. Race outcomes are determined by server-side randomization and are not influenced by any external factors. MemeRace makes no representations regarding the accuracy, reliability, or completeness of any information provided within the App.
To the fullest extent permitted by law, MemeRace shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of funds, loss of data, or loss of profits, arising out of or in connection with your use of the App. MemeRace's total liability for any claim arising from these Terms shall not exceed the amount of SOL you deposited in the 30 days preceding the claim.
MemeRace reserves the right to modify these Terms at any time. Updated Terms will be posted at memeracesol.com/terms with a revised "Last updated" date. Continued use of the App after any such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically.
MemeRace may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, any available session balance will remain withdrawable for a period of 90 days, after which unclaimed balances may be forfeited. You may discontinue use of the App at any time by withdrawing your session balance and disconnecting your wallet.
These Terms shall be governed by and construed in accordance with applicable international laws. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration, except where prohibited by law. You agree to waive any right to a jury trial or class action proceeding.
